These terms are established to rule Exceliums activity which is the online cession of tools to facilitate and promote award calls facilitating the organization, participation and diffusion of the winners and selected candidacies.
Offered services and contents are explained in the website www.exceliums.com and/or other secondary and connected internet domains (from now on: 'The Site').
Services provided by Exceliums are subject to rules. The use that an individual, organization or company makes of the services provided by The Site, will only be deemed licit and authorized when the use is according to every award rules and/or the established obligations with the limits and scope here delimited as well as the ones arising from additional or accessory dispositions and/or different domestic or international regulations that may be of application.
Exceliums is entitled to modify these Terms of Use at any time and with no prior announcement. Those modifications will be operative in the moment of its publication on The Site. Visitors of The Site must be duly updated by checking the Terms on The Site on a regular basis.
The brand Exceliums and the ones on The Site are own brands and belong to Exceliums and the Organizer of each award. Those brands cannot be used for any person, company or organization without previous authorization in writing from Exceliums or the brand owner.
Activity
www.exceliums.com is dedicated to the Award Management for third parties. The participation in those awards can be contracted through The Site.
The Organizer of each Award is its sole responsible and exempts Exceliums for any liability in front of third parties.
Contents and information provided by The Site
Exceliums reserves the right to modify the commercial offer on The Site (modifications on events, dates, prices, promotions and other commercial and service conditions) at any time.
Exceliums strives and does its best within its means, to provide an accurate and error-free information on The Site. Should a mistake, beyond Exceliums purpose, occur, Exceliums will amend it immediately.
Contents on The Site could, sometimes, provide provisional information about some products or services. In the event the provided information does not correspond to the real product or service, client has the right to terminate its registration or purchase at no cost.
Exceliums is not directly or indirectly liable for any content, statement and expressions conveyed in the works registered by the Organizers or Participants in any award on The Site. Organizers or the Participants are sole responsible.
Exceliums is only responsible for damages that have been done intentionally or due to gross negligence caused by its own personnel.
Exceliums system of sales
To organize award calls at www.exceliums.com or participate in them, the user can only register through the Site Registration Form.
Applicable taxes
Prices on The Site include Value Added Tax (VAT) when applicable.
Method of Payment
All payments for services for subscriptions and Organization or Participation in an award and the acquisition of awards must be made through the payment platform on the site, through virtual POS. Otherwise, Exceliums is authorized to reject the call and/or participation in the awards.
Subscriptions to Exceliums will automatically renew annually and the annual fee will be charged to the provided credit card. The cost will always be the one in force at the time of subscription, except for promotions. If prices experience variations, Exceliums will inform users in advance before renewal. Users can unsubscribe at any time from 'my profile' at www.exceliums.com
Forms of Registration and Participation in the events
www.exceliums.com allows the participation of organizations, companies and individuals in the awards as a participant according to the specific participation rules of each award.
Claims
Observed defects and potential claims over them, must be recorded in writing and sent to exceliums@exceliums.com, stating the condition of Organizer or Participant with a copy of the subscription email. Exceliums will amend the defects at the earliest.
Once the claim analyzed, Exceliums will issue a report assessing damages caused to the Participant and establishing the liability.
In the case Exceliums being liable, a compensation according to the caused damages will be established. In no case the compensation will be higher than the refund of the amount paid by the Participant or Organizer of the award.
Resignation by the Organizer
Any Organizer may renounce or waive the organization of his award. To renounce, it must be communicated in writing to exceliums@exceliums.com. Exceliums will assess the situation and will always ensure the rights of the Participants, especially when registration is paid. The resignation by the Organizer supposes the full refund of the registration payments to the Participants.
Limitation of the warranties
Exceliums is not responsible for the acts carried out by the Participants or Organizers and is not liable for any loss or damage of any kind to Participants, Organizers or third parties.
In no case will Exceliums be responsible for the services provided by any entity with which Exceliums collaborates in the provision of services to the Organizers and Participants.
Exceliums is not responsible for personal, intellectual, moral or of any type of damages that the publication of the works by the Participants may cause to third parties.
Exceliums is not responsible for any damage caused by Force Majeure, natural catastrophes, terrorist attacks, strikes or others over which, Exceliums has no control or influence, especially those depending on the actions of third parties, such as electricity supply or the Internet service during an award ceremony. Exceliums is also not responsible for any damage caused by Internet providers.
Participants will not have right to compensation for damages in case of Force Majeure.
Safety regulations
The Organizers of the Awards undertake to keep Exceliums unharmed in front of any judicial or extrajudicial claim raised by any Participant in any Award.

Links to external web sites provided by Exceliums aim to enhance internet browsing experience for The Site visitor or user by offering access to other web sites and its offered products and services. By providing links, Exceliums preserves the original information on the products or services those web sites offer.

Cession of Organizers and Participants rights of contents
The Organizers or Participants in an award, grant the rights of publication to Exceliums, exclusively for the promotion of the awards, and authorize the publication of the works completely free of charge, internationally, without any restriction or reservation.
The Organizers or Participants accept that Exceliums can publish their awards, the participant works and their contents on social networks, in their marketing and advertising promotions.
The Participants expressly state that the works and content they send to Exceliums effectively belong to each participant or have the authorization of the legitimate owners or licensees of the content and do not infringe the intellectual or industrial property rights of third parties.
Organizers and Participants are informed that Exceliums rejects any type of responsibility regarding the exploitation or dissemination of the awards and the projects sent by the participants in any support.
Personal data protection
Exceliums takes the protection of its users' privacy and personal data very seriously and their personal information is kept secure and treated with the utmost care.
The Organizer of a award and the Participants, with the acceptance of these Terms of use of the Platform, consent that the personal data provided for the organization and participation in the awards are incorporated into a file owned by Exceliums to process the participation in the award and to communicate the award list to Participants and third parties.
We inform you that the personal contact information of the Organizers and Participants (name, surname, email address) will be used to send them ""Newsletters"" and information related to the services or future calls published in Exceliums by letter, telephone, email, SMS/MMS, or by other means of communication.
Organizers and Participants guarantee that the personal data provided is truthful. Organizers and Participants are responsible for any personal data modification.
Organizers and Participants in any award may exercise the rights of Access, Rectification, Cancellation and Opposition of their data by e-mail to the following address: exceliums@exceliums.com.
Exceliums maintains the security levels of protection of personal data and has established all the technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the Organizers and Participants data provided through registration, notwithstanding Internet security measures are not unassailable.
Exceliums undertakes to comply with the obligation of secrecy and confidentiality about the personal data in the automated file in accordance with the applicable legislation, as well as to grant them safe treatment in the possible assignments.
